MPs move to strengthen ombudsman's watchdog powers

Namibia's Office of the Ombudsman could soon get real teeth, with the power to prosecute among the amendments proposed under a new bill set to overhaul the 36-year-old law governing the office.The National Assembly is considering the Ombudsman Bill 2026, which seeks to repeal the 1990 legislation and strengthen the institution's independence, powers and ability to protect human rights.Justice minister Wise Immanuel said the bill has three main objectives: repealing the Ombudsman Act of 1990, strengthening the legislative framework that gives effect to Chapter 10 of the Namibian Constitution, and strengthening the ombudsman’s office as a constitutional institution.He said the ombudsman plays a unique role under Article 89 of the Constitution, including protecting individual rights, promoting lawful and accountable public administration, safeguarding the environment and investigating possible misuse of public resources."However, the environment within which the ombudsman operates has evolved significantly," Immanuel said, adding that expectations of public accountability had increased and human rights standards had advanced.The bill would strengthen the ombudsman's ability to address systemic human rights concerns, investigate patterns of maladministration, promote good governance and prevent human rights violations. It would also modernise investigative procedures and clarify the powers available to the office.Immanuel said the proposed legislation would strengthen the institution's administrative and financial autonomy and support its constitutional mandate.Member of parliament Peya Mushelenga welcomed the provision allowing the ombudsman to institute private prosecutions, saying the office had long been "like a toothless dog", able to investigate matters but powerless to act once wrongdoing was uncovered.He also stressed the need for adequate resources and staffing, saying the office should have competent investigators and sufficient means to carry out its functions.aurelia@nmh-hub.com.na
