The Consent Trap: Access to justice for minors pregnant as a result of rape

“Injustice anywhere is a threat to justice everywhere,” Martin Luther King Jr. warned, a reminder that access to justice is not symbolic, but structural. In Namibia, minors who become pregnant as a result of rape are legally entitled to termination, but the very processes designed to protect them can inadvertently make this right impossible to exercise. Time-sensitive procedures, layered consent requirements, and institutional delays mean that a statutory right may exist on paper but quietly expire in practice.Between April 2024 and February 2025, the Namibian Police recorded 4 405 cases of gender-based violence, including 1 345 cases of rape. These statistics are particularly significant for minors. Historical data from the Ministry of Gender, Equality, Poverty Eradication and Social Welfare indicate that approximately one third of reported rape or attempted rape cases involve minors. These numbers highlight the urgency of ensuring that statutory protections are not merely theoretical, but tangible for the children they are meant to safeguard.The Consent TrapNamibia’s legal framework governing termination of pregnancy following rape is set out in the Abortion and Sterilisation Act 2 of 1975 and the Child Care and Protection Act 3 of 2015. Under these laws, a pregnancy resulting from rape may be terminated once several statutory conditions are met. First, two independent medical practitioners must certify in writing that the pregnancy resulted from rape. One of these practitioners must be a district surgeon employed by the state, and both must meet required professional qualifications. They may not perform the procedure themselves.Next, a magistrate must issue a certificate confirming, on the balance of probabilities, that the pregnancy resulted from rape. This determination does not require a criminal conviction, nor must a rape charge be filed, although explanations may be requested if no report has been made.For minors, layered consent requirements further complicate the process. While children aged 14 and above may independently consent to some medical treatment if deemed sufficiently mature, surgical procedures such as abortion require parental, guardian, or caregiver consent. Where such consent is withheld, the law allows substitution: the Minister responsible for child welfare or a Children’s Court may authorise the procedure in the minor’s best interests.The legal framework contains safeguards designed to ensure careful decision-making. However, these safeguards were largely conceived with adult autonomy in mind. When applied to children, who depend on adults, institutions, and procedural approvals to act on their behalf, the protections intended to safeguard them can instead become barriers to exercising their rights.At this intersection of medical certification, judicial confirmation, and layered consent, the Consent Trap emerges. Each safeguard is defensible in isolation, but together they can create delays, dependencies, and logistical hurdles that make it difficult to exercise the statutory right effectively. For a minor, time is critical. Delays at any stage, medical, judicial, or parental, can significantly hinder timely access to safe termination and other protective services.Access to information as access to justiceExercising these rights depends on clear, timely, and accessible information. Minors must understand procedural requirements, timelines, and the roles of social workers, medical practitioners, and other institutional actors. Without this knowledge, the law's protections remain theoretical.Consider a 15-year-old girl in a rural area who reports a rape. She must navigate medical certification, parental consent or Children’s Court authorisation, and judicial confirmation, all while timely access to medical services is essential. Lack of awareness about her entitlements, delayed scheduling, or limited access to qualified medical practitioners can prevent her from exercising her right altogether.Timeliness is essential. The statutory framework anticipates some barriers: social workers may intervene, and courts can authorise procedures where consent is denied. However, these safeguards are meaningful only if the minor is informed and able to access them in practice.Strengthening access Access to justice is structural and operational. Legal rights alone are insufficient if the system is difficult to navigate. Gaps in knowledge, logistical hurdles, and procedural delays can compound trauma, increase social stigma, and prevent minors from exercising the rights guaranteed by law.Social services, healthcare providers, schools, and other institutional actors must work together to ensure that statutory protections are tangible, timely, and accessible. This includes proactive guidance, rapid access to social workers, and support through medical and procedural steps.To make justice attainable for minors, several measures are essential. Develop clear, age-appropriate guides for minors and caregivers that detail procedural steps, timelines, and available support mechanisms. Social workers, healthcare providers, and other institutional actors must be trained to respond efficiently, reduce delays, and navigate consent substitutions when necessary. Introduce fast-track mechanisms to minimise procedural delays, particularly for minors in rural or underserved areas. Cases of minors seeking terminations following rape should be monitored to identify bottlenecks and ensure that legal entitlements are fulfilled in practice. Finally, schools, healthcare facilities, and social services should coordinate closely to proactively identify vulnerable minors and guide them safely through the process.When access to justice is denied, it is not merely an individual failure; it is a structural flaw that undermines the legitimacy of the legal system itself. Upholding these rights ensures that Namibia’s most vulnerable children are not left behind and that the promise of justice does not expire before it can be realised.Ensuring that minors can exercise their rights safely and effectively is a collective duty. The law provides the framework, but society must actively close the gap between statutory entitlement and lived reality.
