Rape accused granted N$1k bail

Johannes Kativa (38), who stands accused of raping a 31-year-old teacher from Guma village in the Kavango East Region, has been granted bail of N$1 000 by the Ndiyona Periodic Court.
Magistrate Sonia Samupofu found that the State had not proven beyond reasonable doubt that the complainant's life would be in danger if Kativa was released.
She further found that Kativa is not a flight risk, as he does not have a passport. The court also took into account that Kativa is the breadwinner of his family.
Conditions
Kativa must report to the Ndiyona Police Station every Friday and may not make contact with the State witnesses.
The case was postponed to 4 May for further police investigation. Kativa was represented by Beatrix Bianca Boois, while Variety Matamata is the prosecutor.
School party
In her testimony during the bail application, the complainant told the court she was “very drunk” and had no recollection of what happened, but was informed about the alleged rape by her son and a neighbour.
She said she and her colleagues were having a party at the school where she works and she consumed alcohol, something she does occasionally.
She said she was in an especially jovial mood after receiving her results from the University of Namibia. They were also celebrating the birthdays of teachers who were born between January and July, and who were unable to hold parties because of the Covid-19 regulations, the complainant said.
Her last memory of the night was being offered a lift by a colleague and she said she could not remember seeing Kativa at the party.
Kativa, who is a father of six, told the court that on the evening of 30 July, he was invited to the school by a teacher who wanted him to bring more alcohol to the party.
He further testified that although the complainant was under the influence of alcohol, she consented to having sex.
