Mistress pays N$40 000 for adultery

WINDHOEKFRED GOEIEMANA Windhoek woman has succeeded in suing her husband and his lover on the grounds that they committed adultery.In a High Court judgement handed down recently, acting judge Esi Schimming-Chase ordered the husbands' mistress to pay N$40 000 which includes claimed damages of N$20 000 for deliberate offensive acts meted out against the wife and another N$20 000 for loss of income.The court further ordered the husband, the first defendant in the matter, to pay the wife a rehabilitative maintenance amount of N$2 000 per month for a period of three years, or until she remarries. Schimming-Chase ordered that the bond of marriage be dissolved while the husband forfeits benefits derived from the marriage in community of property.The husband is also ordered to pay the plaintiff's lawsuit cost in respect of the divorce action. The couple married on December 4, 2010 and no children were born from the marriage.The court, in passing judgement castigated the behaviour of the mistress, including the couple's wedding, after she knowingly became involved in a sexual relationship with the groom.&ldquo;I can see why the plaintiff felt betrayed,&rdquo; said the acting judge.Even more aggravating was the fact that after the wife begged her to stop sending distasteful and insulting text messages, she continued to do so referring to the wife as &ldquo;full moon&rdquo; in reference to her weight.One message read: &ldquo;Full moon is insecure. You are only there for the house and I am there for being shown-off and sexy and ass that drives him crazy.&rdquo; She continued further telling the wife: &ldquo;That which you get, I also get LOL.&rdquo;She also informed the wife that she was sleeping with her husband in their car and was entertaining him at her apartment where he wanted to sleep at night.After receiving the insulting messages the wife reported the matter to the police.According to the judge, there was some element of provocation as well as delight demonstrated by the vindictive mistress.Schimming-Chase added that the mistress appears to have enjoyed humiliating the wife and was blatantly unrepentant.&ldquo;This aggravates damages,&rdquo; Schimming-Chase said. &ldquo;Had the defendants handled the matter differently and (with) some form of good taste, damages would have been significantly less. But to sleep with someone's spouse and then insult that person cannot be accepted, even in today's more open-minded environment.&rdquo;
