Four struggle kids languish in custody

The four struggle kids, who are accused of assaulting and robbing a bus driver, continue to languish custody, with the State unable to say whether it would oppose bail yesterday, as the docket was not available during the court proceedings.
When the defence counsels Florence Gaes and Mbushandje Nthinda inquired about the possibility of bail for their clients, they were told by prosecutor Susan Nyatondo that it was difficult to ascertain whether she would be opposing bail, as docket was not here.
“We can wait for the docket, so we can be able to determine whether bail is going to be opposed or not,” Nyatondo said.
Four of the seven struggle kids originally arrested for assaulting a bus driver on 28 March appeared in the Windhoek Magistrate’s Court in Katutura yesterday and are in custody.
They are Amutenya Hailonga, Tobias Andimba, Ruben Amon and John Kalenga.
The other three original accused were released, as they could not be connected to the crime.
The remaining accused are all charged with robbery with aggravating circumstances.
The accused allegedly stole items worth N$15 638, mainly cash, from 45-year-old bus driver Likius Nanghalu during in the incident.
The four struggle kids reportedly assaulted Nanghalu with their fists, a knobkierie and a pole at the Ndilimani camp near Brakwater, just outside Windhoek.
The victim sustained head injuries, a broken left arm and broken right thumb, after he was beaten, stoned and kicked in an unprovoked mob attack.
He was attacked when he dropped off a struggle kid at the farm on a Sunday afternoon.
Since Magistrate Desire Umunani Kamboua denied them bail, the four remaining accused have been in custody at the Katutura Police Station.
