A farmworker, accused of killing a farmer and raping his wife three years ago, claims he has memory loss.
On Monday, Kazana Nicolaus Hausiku (27) requested that the High Court send him for psychiatric evaluation to prove his memory loss.
Hausiku is accused of hacking to death a 59-year-old farmer with an axe on his plot in the Otjimbingwe area on 10 November 2018.
Although Judge Naomi Shivute granted his request, she was sceptical because Hausiku’s request for mental evaluation came shortly after the State had presented evidence on the charge brought against him.
Hausiku’s mother, Gisbertha Kapanga, had testified in the High Court that he has no history of mental disorder.
Hausiku, however, claims he only started remembering the events after the incident.
Hausiku on Monday also announced he was terminating the services of his legal representative, Tjingari Kaurivi.
The case was adjourned until January 2022.
Background
Hausiku had worked for the couple for three weeks before the attack.
He allegedly hit the farmer on the head with an axe, raped the farmer’s wife, ransacked the house, forced the woman into her car and drove off in it.
About 35 km from the plot, the vehicle overturned on the dirt road and he fled on foot.
The woman was found by passers-by moments later and taken to hospital.
Hausiku pleaded not guilty to all charges. He claimed he had killed the farmer in self-defence.
He also denied raping and kidnapping the woman, claiming that she willingly got into the car. According to him, it was she who drove the car and caused the accident.
