Employers urged to unite

The Namibian Employers' Federation (NEF) has called on the business community to strengthen its collective participation in national legislative and policy processes, warning that the cumulative effect of reforms currently under consideration could significantly influence employment, investment and the sustainability of enterprises.The call followed a series of NEF breakfast meetings held in July 2026 in Windhoek and Walvis Bay, where employers, business associations and labour-relations practitioners considered the extensive reform agenda facing Namibia. The central message emerging from the discussions was that employers cannot afford to respond to each proposal separately or only after legislation has reached an advanced stage. Business needs a coordinated, evidence-based voice that can explain how proposed measures will operate in practice and what their combined effect will be on enterprises and employment.Participants were informed that the current review of the Labour Act is not limited to selected sections but amounts to a comprehensive overhaul of the legislation, extending from the preamble to the transitional provisions. The tripartite process has continued for several years and involves government, organised labour and organised employers. A number of matters remain contested, and the proposals must still proceed through the Labour Advisory Council and the formal legislative process.The Labour Act review is only one part of a much broader programme. NEF is currently involved in approximately 23 interconnected legislative, regulatory and policy processes covering employment equity, occupational safety and health, social security, the proposed national pension fund, labour migration, immigration, productivity, child labour, youth employment and economic empowerment.Although each initiative has its own purpose, its effect on employers cannot be assessed in isolation. Changes to conditions of employment, employee benefits, pension and social security obligations, workplace regulation and the movement of skills may collectively increase the financial and administrative responsibilities borne by businesses. It is therefore necessary to consider whether the overall framework remains affordable, workable and supportive of formal employment.The meeting emphasised that effective employer representation must be supported by reliable operational information, technical expertise and credible research. Employers are best placed to explain how proposals would affect payrolls, staffing decisions, investment, productivity and companies' ability to expand. Without this information, decisions may be taken without a full appreciation of their practical consequences.Particular concern was expressed about the cumulative effect of regulation on small and medium-sized enterprises. Smaller businesses generally have less capacity to absorb additional costs or administrative requirements. Measures intended to protect employees may ultimately undermine that objective if they discourage recruitment, prevent enterprises from entering the formal economy or contribute to job losses.Experience from regional labour policy negotiations also demonstrates that organised business is most effective when employers resolve their differences, establish a common position and participate consistently throughout the consultation process. A unified employer voice does not require agreement on every detail, but it does require businesses to identify their shared interests and present them clearly and responsibly.NEF will continue to participate in the relevant national structures and engage its members as the proposed reforms progress. Once the consolidated Labour Act proposals are available, the Federation intends to assist employers in assessing the likely implications for different sectors and preparing informed submissions.The Federation supports fair labour standards, decent work and appropriate employee protection. These objectives must, however, be pursued within a framework that also recognises the realities of operating a business, encourages investment and enables enterprises to create and sustain employment.
