NCS FC sues Young African over failed N$450,000 league status deal

The Namibian Correctional Service Football Club (NCS FC) has dragged Young African Football Club to the Windhoek High Court, seeking relief to recover N$450,000 it reportedly paid for a premier league status deal that collapsed. The court documents indicate that NCS FC and the Gobabis-based team’s signed the agreement on 29 October 2024 in Windhoek between Absalom Mushaandja, chairperson of NCS FC, and Maleagi Ngarizemo, chairperson and sole owner of Young African FC.The deal stipulated that NCS FC would purchase Young African’s premier league status for N$1.3 million, with a deposit of N$400,000 payable by 2 November 2024, and the remaining N$900,000 due by the end of that month.The agreement also contained a forfeiture clause stating that if the final balance was not paid within seven days after the deadline, the transaction would be nullified and the deposit forfeited.NCS FC further said it complied with its initial obligation by paying the deposit of N$400 000 and later an additional N$50 000 at Ngarizemo’s request. However, despite receiving the money, Young African allegedly failed to transfer any rights, players, or property linked to its Namibia Premier Football League status as agreed.Baseless accusation Although his responses to the legal matter have not yet been filed in court documents, Ngarizemo has repeatedly denied allegations that he sold the club’s premier league status to NCS.Earlier this year, Ngarizemo dismissed the claims, saying: “These are all lies. It is within our rights to hold discussions if we choose to, and yes, we did talk last October when NCS faced expulsion from the league but nothing materialized. Negotiations were never finalized.”Ngarizemo further maintained that his team remains financially self-sustaining. NCS has, however, accused Young African FC of unjust enrichment and bad-faith renegotiation, claiming that the Gobabis-based club benefited from a deposit of N$450,000 without honouring the agreement or refunding the payment.
