Businessman insists sex was consensual
An Ondangwa businessman was granted N$20 000 bail yesterday after insisting that his accuser 'took away' his erection after what he claims was a consensual encounter.
Ondangwa businessman Otto Shikomba, popularly known as Niimboto, yesterday said a 23-year-old student nurse who accused him of rape has ‘stolen’ his erection since their first consensual sexual encounter on 31 March.
Niimboto made the remarks during his formal bail application in the Ondangwa Magistrate’s Court.
Bail of N$20 000 was eventually granted after a long day of legal arguments – led by the accused’s lawyer Sisa Namandje, and countered by state prosecutor Brunah Mukoya and magistrate Alice Gawanas.
Niimboto, a married millionaire with an estimated wealth of N$22 million, denied raping the complainant, insisting the sex was consensual.
He is accused of raping the victim on three separate occasions.
Mukoya opposed bail, saying the accused is a well-known and influential businessman who would interfere with the investigations. Gawanas, however, granted bail, saying she is disappointed by the argument presented by the State for opposing bail.
She said the State also called Oshana crime investigative coordinator, deputy commissioner Hilja Haipumbu, to the stand as a witness, but that he was not well-versed in the case. Haipumbu was standing in for the investigative officer.
‘Beautiful boobs’
Niimboto told the told the court that he met the complainant for the first time on 28 March 2022. When he met her, he was fascinated by her appearance and informed her that she had beautiful boobs that he would love to suck, he said.
The businessman told the court that he called the woman the same day and asked her to meet with him on 30 March. He said they met at his house in Ondangwa and had consensual sex that same day. He travelled to Windhoek the next day, 1 April.
Niimboto told the court that on 2 April, he received a text message from his accuser that read: “My love, I need you to send me cosmetic money”. He ignored the message and did not reply to it, he narrated.
When he returned to the north, he called the woman on 3 April, and she agreed to meet him again, but suggested that it be at night so that she “doesn’t get in trouble” with his wife and her aunt.
The accused narrated that he picked her up and they drove to a guest house near Oshitayi, where he paid for a room. There, he said, the woman confronted him about the money she allegedly asked for.
“From my understanding, it is the cosmetics money. I then gave her N$800. I asked if it was enough and she said yes. We proceeded and had protected sex,” he told the packed court room.
Lost his manhood
The State told the court that the complainant accused Niimboto of having been drunk the first day they met and that he started fingering her while parked outside his house. He denied having been drunk.
The prosecutor then told the court that on 3 April, he informed the complainant that he had a problem he wanted to discuss with her. The problem, the State argued, was that he could not get an erection.
Niimboto went on to tell the court that he has indeed lost his manhood after his sexual encounter with the complainant, and wanted it corrected.
The state charged that Niimboto allegedly took the complaint to the guesthouse at Oshitayi and demanded that she has sex with him to fix the erection problem.
He told the court that the woman told him that she has a boyfriend and would only accept N$300 or N$400 each time they had sex, but promised to continue sleeping with him until his erection problem had been ‘solved’.
He also told the court that the woman suggested that he go to church for prayers and he refused because “she was the one who took away” his erection and “must reverse it”.
Niimboto’s bail conditions are that he must report to a police station once a month. He may not go near the complainant’s house, nor contact her.
