#JustIn: AG in Supreme Court tomorrow
The Namibian Attorney General, Festus Mbandeka (pictured), will have his appeal case against the high court's decision to release certain documents relating to cabinet decisions on Covid-19 regulations heard in the Supreme Court tomorrow.
Hollard Insurance had applied to the high court for the disclosure of certain documents relating to cabinet decisions on the establishment of regulations during the Covid-19 pandemic outbreak. Hollard also requested an order for the AG to attend the court proceedings to present the documents. Hollard's application was granted and a subpoena was issued for the AG.
However, the AG was dissatisfied with the high court's decision and applied for an order setting aside the subpoena on the grounds that it was defective, irregular and invalid. The court dismissed the AG's application.
The court ruled that the AG had failed to prove that the subpoena was an abuse of the court process and that the documents in question were irrelevant to the proceedings.
The AG is now appealing the high court's ruling and orders in the Supreme Court.
