JUST IN: NEFF's case against the ECN in court today
The Namibia Economic Freedom Fighters' (NEFF) urgent application against the Electoral Commission of Namibia (ECN) began this morning in the Windhoek High Court. NEFF brought the application in an attempt to set aside ECN's decision to deregister the party.
NEFF claims the ECN's decision was premature, irrational and violated common law and the Namibian Constitution. The ECN argues that the application is not urgent and has requested that it be struck from the roll.
During the proceedings, it was said that this is the first application of its kind in the history of Namibia's courts and therefore there is not much of a legal framework for it. NEFF presented its arguments in court this morning after which the court briefly adjourned. Proceedings will soon continue with the ECN presenting its arguments before Judge Thomas Masuku.
