Sexual complainant turns accused

A 23-year-old man who opened an indecent assault case against two men was arrested on the same day and subsequently accused of the same act by a 27-year-old female doctor, reportedly a relative to one of the suspects.

The two men accused in the first case appeared before the Oshakati Magistrate’s Court yesterday.

Franky Cloete (32), a doctor, and Brian Kavungo (30), a teacher, appeared before magistrate Josanne Klazen. She postponed the matter to 27 July for further police investigation and granted both suspects bail of N$2 000.

State prosecutor Pallhus Shuudeni agreed that Cloete and Kavungo could be granted bail on condition that they do not make contact with the complainant and that they do not repeat the same or similar offence.

A student teacher who is the complainant in the first case has also been arrested and appeared in court. The suspect, who cannot be named because he is the complainant in the other case, allegedly inappropriately touched a 27-year-old female doctor at the same flat in Ongwediva on the same night.

It is alleged that the man approached the woman in order to escape from the sexual advances of the other two men.

Oshana police spokesperson Inspector Thomas Aiyambo said the men had removed the complainant's trousers, kissed him and touched his private parts.

He then woke up the woman, who was sleeping on the sofa, to rescue him.

“He later managed to get a remote for the gate, and that is how he managed to go and report the incident to the police,” Aiyambo said.

The student teacher also pleaded not guilty. His case was postponed to 27 July for further police investigation. He was granted bail of N$1 000.
