Several Sanlam accused granted bail

Six accused persons implicated in an alleged N$2.2 million insurance-related money laundering scheme involving Sanlam were each granted bail of N$25 000 each by magistrate Bornface Konga in the Ondangwa Magistrate’s Court on Friday.The accused, who were arrested earlier this year, face multiple charges, including fraud, forgery, and contravening the Prevention of Organised Crime Act (POCA). The State alleges that they used their offices and positions for gratification by facilitating false insurance claims.Festus Amwaalwa, a former Onandjokwe Intermediate Hospital employee; Albertina Simeon and Gertrude Iipinge, both Sanlam employees; Dr Carlos Varela Gomes, a Malawian national and doctor at Onandjokwe State Hospital; Kelsey Kudumo, an intern doctor at Onandjokwe; and Michael Kaviu, a nurse at Omuhungo Clinic, were each granted bail.In his ruling, Konga said the State had failed to provide a rational basis for differentiation for denying bail, especially since other co-accused facing similar charges had already been released on bail.The court also found that some of the charges were vague, specifically those under POCA, noting that the charge sheet lacked sufficient detail on the specific offences allegedly committed by the applicants.On the risks of abscondment, witness interference and obstruction of the administration of justice, the magistrate was satisfied that such risks could be addressed through stringent bail conditions.The magistrate further noted that bail would allow the accused to provide for their children and dependents.“The proper administration of justice requires that an accused be afforded the opportunity to prepare for trial, to consult with legal representatives freely, and to attend to personal health and family obligations at their own cost. This also relieves the State of unnecessary custodial expenses,” Konga said.Strict conditionsWith respect to Festus Amwaalwa, who has separate pending matters, the court held that the existence of other cases does not automatically preclude an accused from being granted bail.The court imposed strict bail conditions. All six accused are ordered not to commit any offence similar to the one charged while on bail. They must surrender all travel documents to the investigating officer, refrain from contacting state witnesses or any co-accused, and must not interfere with the investigation or prosecution in any manner.They are further required to report to the investigating officer every Monday and Friday and to attend court on all remand dates. The magistrate warned that failure to comply with any condition may result in the cancellation of bail.In related proceedings also heard on Friday, Anna Sofia Amunwemade made her first appearance and was granted bail of N$25 000 on similar conditions.Abner Samuel Kotokeni and Paulus Nuuyoma were, however, denied bail and are expected back in court on Monday for a formal bail application.The matter was postponed to 17 September for further police investigation.
