Man denied bail for alleged rape of teen boy
Ondangwa Magistrate’s Court denied a man accused of raping a 17-year-old boy bail on Monday.
Andreas Weyulu Mtula is accused of raping the teenage boy on two separate occasions this year.
Oshana crime investigation coordinator, deputy Commissioner Fredrick Ndjadila, said the suspect faces charges under the Combating of Rape Act, Act 8 of 2000.
Mtula appeared before Magistrate Nelao Ya France, and his case was postponed to 11 November 2025 for further investigation.
He will be remanded in custody.
State objects bail
The state objected to the granting of bail due to the serious nature of the offence and Mtula's propensity to commit similar crimes.
The court documents also state that it is not in the interest of justice or the public interest for the accused to be released on bail.
Further along, the state also fears the accused may interfere with police investigations and or state witnesses.
Mtula denied the rape allegations in court on Monday, questioning why he would rape a male person whilst there was a woman in the room.
He was informed through an interpreter that this was his first appearance and that the matter was still under investigation.
“About the charges, there will be an appropriate place and time for you to challenge the evidence. However, this is not the time to do so. Do you understand?” Ya France asked.
Mtula nodded in agreement and indicated that he would conduct his defence.
He was also informed that although the state is objecting to bail at this stage, he still has the right to apply for a formal bail application.
Ndjadila said the alleged rape incidents occurred during January 2025 and again on 1 June 2025 at Ehafo Lya Nelundu village in the Uukwiyu Uushona constituency.
The matter was reported by the victim’s 59-year-old father from Iikokola Village.
Offered N$200
“The middle-aged man is alleged to have first approached the victim in January 2025, asking him to walk with him to his house.
"While on the way, the suspect allegedly began to touch the victim's back before grabbing him and pulling him down,” he said.
Ndjadila said it is further alleged that Mtula undressed the teenage boy and molested him.
He added that the accused then reportedly offered the victim N$200.
On the alleged second rape incident, Ndjadila said Mtula again requested the victim to accompany him to his house, where he allegedly raped him.
