Chinese businessman counter-sues ex-employee

Chinese businessman Li Bailong has filed a counter-suit of N$500 000 against former employee Itakeya George, who had accused him of stripping her naked in full view of co-workers and customers.

Apart from the N$500 000 claim, Bailong also wants George to retract her statements and apologise to him unconditionally.

George had earlier this year approached the High Court to sue her former boss for N$500 000 for the alleged humiliation she suffered following the event of 6 November 2021 when she was allegedly order by Bailong to remove her uniform in view of co-workers and customers at his fabric store in Windhoek’s China Town.

According to the court papers filed by Bailong through his lawyer Ileni Velikoshi, he argues that his reputation has been tarnished by the allegations George had made on various media platforms.

Bailong says the "false and defamatory accusations" painted a picture of him being selfish and cruel, vindictive in nature, not a law-abiding Chinese national who lacks moral fibre and is a criminal.

“The falsehoods, statements, innuendos, and distortion of facts are injurious to the dignity of the defendant and were made and circulated and published with the sole purpose and intention to damage and harm the reputation and dignity of defendant and by extension his business in the eyes of the Namibian community and abroad,” Bailong argues.

“As a result of the publication and circulation of the above false suggestion, insinuation, and defamatory statements by the plaintiff and the context in which they were made, [the] defendant suffered damages to his reputation and dignity in the sum of N$500 000.”

Criminal case withdrawn

Bailong has also provided the court with a court order dated 25 January 2022, which indicated that the criminal case against him had been withdrawn by the State.

According to the court order, Prosecutor Arric Albertus Husselmann approached the Windhoek Magistrate’s Court with an application in terms of Section 6(a) of the Criminal Procedure Act to withdraw the matter.

Magistrate Dawid Mukuyu subsequently granted the application of the State and the case was dismissed.

Bailong was refunded his N$1 000 bail money.

Unaware

Meanwhile, George’s lawyer, Henry Shimutwikeni, told Namibian Sun that he only learned about the withdrawal of the criminal case on 2 April when the plea was filed.

“It only came to our attention that the criminal matter was withdrawn after the plea was filed. We are definitely going to look into it,” Shimutwikeni said.
