Electronic signatures under scrutiny

In an effort to improve efficiency and security in the digital economy, the information and communication technology, in collaboration with the Communications Regulatory Authority of Namibia (Cran), is working to tighten regulations for electronic signatures.

"This is a good thing because we live in a digital world... Electronic signatures are beneficial because you don't have to go to a branch of a bank, state agency or financial institution," digital expert Paul Rowney affirmed.

"Electronic signatures enhance security guidelines that protect against fraud and unauthorised access.

"Clear regulations also promote trust, ensuring that digital transactions are just as reliable as traditional transactions," said information ministry spokesperson Ngaevarue Katjangua and Cran spokesperson Mufaro Nesongano in a joint statement last week.

"Standard protocols can facilitate cooperation between various platforms for electronic signatures, making it easier for businesses and individuals to engage in cross-border transactions," Katjangua and Nesongano explained.

Legal aspects

Rowney said it is important to address the legal aspect concerning electronic signatures.

"We could expose ourselves to risk, so we need to look at how we verify it, because if someone can manipulate a document, they can use your signature. Therefore, we must ask ourselves: what systems are we going to use? How do we hold people accountable? Who are we going to hold accountable?"

MICT and Cran said plans are being discussed to address this concern.

"Improved regulations help address ambiguities in legal rights and ensure that electronic signatures are recognised and enforceable across various jurisdictions, ultimately promoting a more efficient and secure digital economy," Katjangua and Nesongano noted.
