Noa says sexual assault accuser made first move

Medical doctor Dennis Noa has told the Ondangwa Magistrate’s Court that the taxi driver who accused him of sexual assault initiated their sexual encounter and even wanted to have unprotected sex, which he refused.

Noa, 31, made the claims on Tuesday while testifying in his bail application before Magistrate Shantell-Antoinette Wanga-Harris.

He faces one count of sexual assault, allegedly committed at his residence in the Onandjokwe Hospital area.

Through his defence lawyer, Beatrix Bianca Boois, Noa told the court that he knows the complainant, a taxi driver, and that their interaction began earlier this year after he hired his taxi in Ondangwa.

Noa said that on 7 May 2026, he hired the complainant after shopping for his sister’s birthday.

“I paid N$150 for all the seats because I was in a hurry to travel from the north to Windhoek,” he testified.

He said the complainant dropped him off at his residence in the Onandjokwe Hospital area and later asked for his telephone number for future transport.

That same evening, Noa said he contacted the complainant to take him to Olunkono, where he intended to catch an Intercape bus to Windhoek.

The complainant later sent him a message to check whether he had arrived safely, the court heard.

Noa testified that on 22 May, the complainant invited him for drinks at a lounge in Ondangwa.

“I am the one that paid for his beers and I bought my Johnnie Walker and then we proceeded to the next lounge where I purchased some drinks,” he said.

The complainant later drove Noa back to his residence at the hospital.

According to Noa, the complainant followed him into his room, saying he needed to charge his phone and wanted to sleep over because he was intoxicated and could not drive.

Noa said he agreed to let him stay.

He testified that the complainant subsequently initiated physical contact.

“That night, I felt physically touched. The complainant touched my nipples, neck and private parts and asked if we could have sex that night and I agreed,” Noa said.

Noa told the court that the complainant wanted to have sex without protection, but that he insisted on using a condom.

“There was no force used and that day we had sex,” he testified.

Noa said he gave the complainant an energy drink the following morning.

He further testified that the complainant subsequently told him he had two children, was attracted to women and only engaged in sexual activity with men when intoxicated.

Noa also told the court that he and the complainant continued communicating after the alleged incident.

“From there I wanted to focus on my career,” he said.

He added that he believed the complainant was also trying to understand his own sexuality.

Noa has denied the allegation against him and told the court that the sexual encounter was consensual.

The bail application continues.
