Grootfontein to pay Sinvula N$3m

The Grootfontein municipality is awaiting approval from the urban and rural development ministry to pay out the contract of its controversial CEO Kisco Sinvula - an amount close to N$3 million.

This is contained in documents seen by Namibian Sun in which the council wrote to urban and rural development minister Erastus Uutoni, seeking approval to pay Sinvula N$2 974 844 as his exit package from the local authority.

“The council has agreed to pay an amount of N$2 974 844 to Mr Kisco Sinvula once the approval is granted and the agreement will be signed,” Grootfontein mayor Thalitha Garises wrote to Uutoni.

He is yet to respond.

Council terminated Sinvula’s contract on 24 May as a result of the disintegration of the relationship between the two parties.

Of the council’s 70 employees, 50 voted in favour of Sinvula’s removal from office in a recent petition.

Sinvula last month resumed work after serving a 14-month suspension.

He resumed duty after the High Court in May ruled that his suspension was illegal.

Despite the ruling, council decided that as the relationship between the parties had become toxic, it would terminate his contract with immediate effect.

As council awaits ministerial approval to pay out Sinvula, the latter through his lawyer, Veiko Alexander, on 22 June wrote to council lawyer Henry Shimutwikeni, demanding that he resume his duties.

“[Sinvula] demands that [the council] discontinue all acts directed towards him, resulting in and having the effect of preventing him from discharging his duties as the CEO,” Alexander wrote.

“In this regard, we make the point that client remains the substantive CEO until such time that he agrees to a mutual termination of his employment contract, or his employment contract terminates by effluxion of time, or he is lawfully discharged in terms of the applicable provisions of the Local Authority Act.”

Shimutwikeni responded that Sinvula’s contract was terminated, thus he cannot resume any work at the municipality.

He further instructed Sinvula to wait for the money that is due to him.
