Man guilty of ex-lover's death
The Oshakati High Court on Wednesday found Elia Shituwa Iipinge (44) guilty of culpable homicide for the death of his ex-lover, Nangombe Indongo in 2013.
Judge Werner Januarie when making his ruling, said the court found that Iipinge did not intend to kill Indongo and thus, he was convicted on a charge of culpable homicide.
The matter was remanded to 1 February for mitigation of sentence.
Indongo died on 22 February 2013 after she was involved in a fight with Iipinge at Oluhalu village in Outapi district in the Omusati Region. They had fought the previous night and it is alleged that he kicked her in the stomach causing her liver to swell and eventually, rupture. She died while being transported from Okahao hospital to Oshakati Intermediate Hospital.
Since his arrest on 25 February 2013, Iipinge denied having assaulted Indongo.
Indongo's mother testified that her daughter, on the day of her death, before she was taken to the hospital told her that she was beaten by Iipinge.
Another witness testified that Iipinge had told him that they had fought the night before she died.
According to his testimony, Iipinge said he escorted Indongo, his ex-lover, to the well to collect water on the evening of 21 February 2013,
This was around 21:00.
He said on their way back to her home, Indongo stumbled and fell on a rock which could have caused the injuries she sustained.
However, they did argue a little later at Indongo's home about his new girlfriend. The fight, he said, escalated to the point where he slapped her because she had pushed him.
He ended up spending the night but testified that Indongo vomited frequently throughout the night, prompting him to inform her mother that she was ill. He also secured transport for her to the Okahao State Hospital. She was referred to Oshakati Intermediate Hospital, but died en route.
